Official Rules and Regulations
COMPETITION DESCRIPTION
1. The A-Channel Vancouver Island & Save-On-Foods “Amazing
Kids” competition (the “Competition”) commences
12:00 a.m. (ET) October 1, 2006 and concludes
11:59 p.m. (ET) September 30, 2007 (the “Competition Period”).
The competition is brought to you by A-Channel Vancouver Island,
a division of CHUM Limited (A-Channel Vancouver Island and CHUM
Limited and all its divisions are collectively referred to as “CHUM”)
and is sponsored by Save-On-Foods (CHUM and Save-On-Foods are collectively
referred to as the “Competition Sponsors”).
ELIGIBILITY
2. The Competition is open to all legal residents of Vancouver
Island, British Columbia who are eighteen (18) years of age or
younger.
3. Notwithstanding the above, the Competition
is not open to individuals associated with the competition, including
the employees, agents or representatives of the Competition Sponsors
(including their respective divisions, subsidiaries, affiliates
and advertising or promotional agencies) and suppliers providing
prizes or other materials or services in connection with this
Competition (collectively, the “Excluded Individuals”).
This Competition is also not open to the immediate family members
of the Excluded Individuals and all other persons with whom the
Excluded Individuals reside.
HOW TO ENTER
4. To nominate an Amazing Kid, visit www.achannel.ca or www.saveonfoods.com
and fill out an on-line entry form with the first name only of
the Amazing Kid, your name, mailing address and daytime telephone
number. Alternatively, visit any Vancouver Island Save-On-Foods
location to pick up a nomination form. There will be 52 Amazing
Kids selected during the Competition Period.
5. No purchase is required to enter.
PRIZE
6. Each week, A-Channel News will feature the
Amazing Kid (the “winner”)
of the Week on Thursday nights between 5 pm and 7 pm PST, and will
award the Amazing Kid a cheque for $1000.00.
SELECTION
7. Amazing Kids are selected on the following
criteria: distinction in athletics, academics or the arts; or
demonstrated leadership and service in the community. Each week,
one entrant will be selected from all eligible nomination entries
received and deemed as the potential Amazing Kid of the Week
in accordance with paragraph 4 above. In order to be confirmed
as that week’s Amazing
Kid, the nominator must obtain the permission of the nominated
Amazing Kid or, in the event that the nominated Amazing Kid is
under the age of 13, the permission of the parent(s)/ legal guardian
of the nominated Amazing Kid, to appear on the news segment and
to forward his/her full name and daytime telephone number to A-Channel
so that he/ she may be contacted.
8. In order to be declared an Amazing Kid by the Judging Panel,
a potential winner must be in compliance with these Official Rules
and Regulations and, in particular, the following:
8.1 A CHUM employee must be able to reach the
potential winner by telephone within five (5) days of the date
on which the potential winner’s nomination form was selected.
8.2 The potential winner must complete, sign and return a standard
form declaration and release prepared by CHUM within ten (10) days
from the date on which the form is sent to the potential winner.
9. If a potential or declared winner is not in compliance with
these Official Rules and Regulations, the competition judges reserve
the right to disqualify such entrant from the competition and choose
another potential winner from the remaining eligible entries until
a winner is finally declared.
11. Each declared winner consents to the Competition
Sponsors’ use
of his/her name, photograph, voice, statement and image for any
publicity or programming purposes, in all media, without remuneration,
throughout the world in perpetuity.
12. Entrants will not be individually contacted, except for selected
entrants or declared winners, who will be contacted by telephone.
GENERAL
13. The decisions of the Competition judges are final, and entrants
agree to abide by all of the instructions and decisions of the
Competition judges. In the event of any dispute regarding the interpretation
of these Official Competition Rules and Regulations or any decision
rendered by the Competition judges, the decision or interpretation
of the Competition judges shall prevail.
14. All entries become the sole property of, and are subject to
verification by, CHUM. Any entry that is illegible, incomplete,
altered, or contains false information, is invalid. The use of
any automated equipment to participate in this Competition is prohibited.
15. Any attempt to tamper with the entry process, interfere with
these Official Competition Rules and Regulations, deliberately
damage any website or undermine the administration, security or
legitimate operation of the Competition, is a violation of criminal
and civil laws and the Competition Sponsors reserve the right to
seek damages and/or other relief from all persons responsible for
such acts to the fullest extent permitted by law, which may include
banning or disqualifying entrants from this and future CHUM competitions.
16. The Competition Sponsors assume no responsibility
for: entries lost, stolen, delayed, damaged or misdirected, or
for the failure, interruption or delay of any email or other
communication to be received, for any reason; problems with the
function of any website or website feature howsoever caused;
the malfunction of, or damage caused to, any telephone network
or lines, computer equipment, data or software, online systems,
servers or access providers; any functionality lost due to not
having cookies enabled; traffic congestion on the Internet; the
security or privacy of information transmitted via computer networks;
or for breaches of privacy due to interference by third party
computer “hackers”.
17. The Competition Sponsors reserves the right, in their sole
discretion, to substitute any component of a prize for its cash
value or a prize of approximately the same retail value. Prizes
are non-transferable, must be accepted as awarded by CHUM and cannot
be exchanged by a declared winner for cash or other substitutes.
The refusal by an entrant to accept any prize releases and forever
discharges the Competition Sponsors and their agents of all obligations
related to the prize including delivery.
18. CHUM reserves the right, at its sole discretion and without
prior notice, to amend, cancel, close, suspend or reinstate this
Competition at any time and for any reason whatsoever.
19. By entering the Competition, each entrant
agrees to abide by these Official Competition Rules and Regulations,
which are subject to change without notice to Competition entrants
individually, and each entrant releases the Competition Sponsors,
their respective parents, affiliates, subsidiaries, directors,
officers, employees, representatives, agents and advertising
and promotional agencies, from any damage, loss or liability
suffered as a result of or arising from the entrant’s participation
in the Competition or the use of any prize.
20. The Competition is void where prohibited by law and is subject
to all applicable federal, provincial and municipal laws and regulations.
21. The Competition and these Official Competition Rules and Regulations
shall be exclusively governed by and construed in accordance with
the laws of the province of British Columbia. Any dispute shall
be adjudicated in the courts sitting in Vancouver, British Columbia.
